V\u00e4nsterextremisterna i Civil Rights Defenders skriver:<\/span><\/p>\n

Avhysningen fr\u00e5n Sorgenfri kritiseras av FN<\/strong><\/p>\n

Det \u00e4r endast en person<\/strong> – Rita Izs\u00e1k – som enligt \u00f6nskem\u00e5l fr\u00e5n Civil Rights Defenders st\u00e4ller fr\u00e5gor om vad som h\u00e4nt baserat p\u00e5 den f\u00f6rljugna bild av verkligheten som Civil Rights Defenders givit Rita Izs\u00e1k<\/strong>.<\/span><\/p>\n

Den senaste tiden har blickarna riktats mot Malm\u00f6 med anledning av avhysningen av de omkring 200 EU-migranterna fr\u00e5n boplatsen p\u00e5 Sorgenfri i b\u00f6rjan av november.<\/p>\n

Civil Rights Defenders har den 30 oktober, i ett \u00f6ppet brev till Malm\u00f6 stad, uttryckt oro \u00f6ver att avhysningen inneb\u00e4r att Sverige kr\u00e4nker de boendes m\u00e4nskliga r\u00e4ttigheter och d\u00e4rmed bryter mot de internationella \u00e5taganden staten har \u00e5tagit sig att f\u00f6lja<\/strong>.<\/p>\n

Red’s kom:
\nSom med all \u00f6nskv\u00e4rd tydlighet framkommit tidigare s\u00e5 har i aktuellt fall ingen brutit mot n\u00e5gra m\u00e4nskliga r\u00e4ttigheter eller n\u00e5gra internationella \u00e5taganden som staten \u00e5tagit sig att f\u00f6lja.<\/span><\/p>\n

Sedan har Civil Rights Defenders inte ”uttryckt oro<\/em>” \u00f6ver n\u00e5got. De har ist\u00e4llet grundl\u00f6st anklagat<\/strong> Malm\u00f6 Stad f\u00f6r att bryta mot m\u00e4nskliga r\u00e4ttigheter och baserat sina anklagelser p\u00e5 ett antal r\u00e4ttsfall helt utan relevans f\u00f6r avhysningen.<\/span><\/p>\n

V\u00e5r kritik f\u00e5r \u00e4ven st\u00f6d av FN:s s\u00e4rskilda rapport\u00f6r f\u00f6r minoritetsfr\u00e5gor, Rita Itzak<\/strong>, som i ett brev till utrikesminister Margot Wallstr\u00f6m kritiserar st\u00e4ngningen av Sorgenfri och uttrycker stark oro \u00f6ver att avhysningen \u201dkan f\u00f6rst\u00e4rka romernas utanf\u00f6rskap och den marginaliserade st\u00e4llning som gruppen har och f\u00e5 allvarliga konsekvenser f\u00f6r deras grundl\u00e4ggande m\u00e4nskliga r\u00e4ttigheter<\/em>\u201d.<\/p>\n

\nDet \u00e4r riktigt att det f\u00f6rekommer okunniga p\u00e5st\u00e5enden av Rita Izs\u00e1k som kan tolkas som att hon tror att det finns n\u00e5got regelverk som skulle s\u00e4ga att Sverige \u00e4r skyldig att f\u00f6rs\u00f6rja all v\u00e4rldens medborgare, men det faller p\u00e5 sin egen orimlighet f\u00f6rutom det faktum att n\u00e5gra s\u00e5dana regelverk inte existerar p\u00e5 n\u00e5got s\u00e4tt.<\/span><\/p>\n

FN:s s\u00e4rskilda rapport\u00f6r st\u00e4ller ocks\u00e5 ett flertal viktiga fr\u00e5gor till utrikesministern om processen som ledde fram till beslutet och vilka \u00e5tg\u00e4rder man har tagit f\u00f6r att s\u00e4kerst\u00e4lla att de boende inte blir heml\u00f6sa.<\/p>\n

Exellency,
\nI have the honour to address you in my capacity as special Rapporteur on minority issues pursuant to Human Rights Council resolution 25\/5.<\/p>\n

In this connection, I would like to bring to attention of your Excellency’s Government information I have received concerning the alleged imminent eviction of 150-200 Roma individuals, including minors and pregnant women, from the Sorgenfril\u00e4gret (”The Sorgenfri camp”) Roma settlement in the Norra Sorgenfri area of the municipality of Malm\u00f6, which is scheduled to take place on 1 November 2015.<\/p>\n

According to information received:<\/p>\n

On 27 October 2015, the Malm\u00f6 municipality its intention to evict the Sorgenfril\u00e4gret Roma settlement, following a decision handed down by its environmental council that the settlement poses a health risks to the population living in the camp. Reasons stated for the eviction include soil pollution due to the location of the settlement in a former industrial area, the lack of adequate sanitation services, and the accumulation of household garbage which has heightened the risk of infection for residents of the settlement.<\/p>\n

The Sorgenfril\u00e4gret settlement is home to approximately 150-200 Roma including minors and pregnant women, all of whom Romanian nationality. It is the largest Roma settlement in Sweden.<\/p>\n

Some of the residents have been living in the settlement for one and a half years, and most of them have been living in the settlement between three and eight months.<\/p>\n

Residents of settlement do not have access to basic services, such as basic sanitation, water supply and garbage collection despite repeated requests for such services from the community to the Malm\u00f6 authorities.<\/p>\n

D\u00e4remot fanns container f\u00f6r sopor, d\u00e4r romerna dock f\u00f6redrog att sl\u00e4nga sina sopor antingen utanf\u00f6r containern eller n\u00e5gon annanstans.<\/span><\/p>\n

Sverige har ingen skyldighet, och f\u00e5r inte ens enligt lag erbjuda detta p\u00e5 skattebetalarnas bekostnad.<\/span><\/p>\n

Basic garbage disposal services and two portable toilets have been provided by a local NGO, funded jointly by the residents of the settlement.<\/p>\n

Following the announcement of the intention to demolish the settlement on 27 October 2015, Roma residents were given five day notice of the pending eviction.<\/p>\n

The municipality has reportedly offered alternative accomodation for affected persons for a maximum of five nights on the basis of ’extreme weather’.<\/p>\n

\nCivil Rights Defenders har f\u00f6rs\u00f6kt ljuga sig och andra bl\u00e5a. Nej, erbjudandet var max 2-3 dagar evakueringsboende oavsett v\u00e4der<\/strong>.<\/span><\/p>\n

However it seems that the city council only has a capacity of 50 beds, which is insufficient to house the 200 affected persons.<\/p>\n

It is also envisaged that another shelter may open on December 2015 and operate during the winter months only (December-February), which will also have an additional capacity of 40 beds.
\nThese alternative accommodation options are clearly insufficient<\/strong> to meet the needs of the affected residents of the Roma settlement.<\/p>\n

\n Varf\u00f6r riktas inte eventuell kritik till d\u00e4r den h\u00f6r hemma, dvs Rum\u00e4nien och Bulgarien?<\/span><\/strong><\/p>\n

Moreover, there is already a current population of approximately 300 homeless Roma people in Malm\u00f6.<\/p>\n

Rita Izs\u00e1k skiljer i sitt resonemang inte mellan EU-migranter (romer fr\u00e5n andra l\u00e4nder) och svenska romer.<\/span><\/p>\n

Affected Roma families from the Sorgenfril\u00e4gret settlement have also repeatedly been offered ticket to return to their home countries.<\/p>\n

It is also alleged (av vem?)<\/span> that if the residents of the settlement do not vacate it by the date specified, 1 November 2015, the municipality may request the assistance of the police to clear the settlement.<\/p>\n

Reportedly, there is a current case pending before the Environmental Court of Appeals regarding an earlier attempt to evict this community. On 23 April 2015 a first eviciton decision regarding Sorgenfril\u00e4gret settlement was issued by the city environmental council (Milj\u00f6f\u00f6rvaltningen). This decision was overturned in favour of the Roma comunity by the supervising body (L\u00e4nsstyrelsen). That decision was subsequently appealed by the municipality to the Environmental Court, which also ruled in favour of the community. The case is currently pending trial before the Environmental Court of Appeals (Mark- och Milj\u00f6\u00f6verdomstolen).<\/p>\n

Without awaiting the decision of the Environmental Court of Appeals, the Malm\u00f6 municipality, by using r\u00e4ttelse, a special legal mechanism<\/strong>, was able to secure the current separate eviction order over the community on 27 October 2015. The r\u00e4ttelse is reportedly a special mechanism<\/strong> that empowers authorities to act independently and is intended to be used in cases where there is a particular necessity to act to prevent environmental damage. It also does not allow for a review of the reasons for the decision by an independent court or tribunal.<\/p>\n

It is alleged that the authorities should not have used the r\u00e4ttelse<\/em> to seek a separate eviction order, and should have awaited the outcome of the case pending in the Environmental Court of Appeals, which reportedly prevents new legal proceedings to be lodged by the local authorities.<\/p>\n

On 28 October 2015 the community has filed an appeal against the decision of the environmental council made through the ”r\u00e4ttelse<\/em>” mechanism; however it is unclear whether this appeal will have injunctive effect as the decision of the environmental council specifies immediate implementation.<\/p>\n

Allegedly, in all of the above judicial proceedings, the local authorities failed to adequately consult with the Roma residents<\/strong> of Sorgenfril\u00e4gret, and also failed to inform them on how and where to apply for legal aid<\/strong> after the decisions on the evicitons were issued.<\/p>\n

Det fanns inget att konsultera med ockupanterna. Vad skulle detta vara? Det f\u00f6rekom ett mycket stort antal informationstillf\u00e4llen, som aldrig skulle ha givits om det inte handlat om romer.<\/span><\/p>\n

Ockupanterna hade konstant juridisk hj\u00e4lp. Inte f\u00f6r att det gjort n\u00e5gon skillnad om de haft detta.<\/span>
\n Sedan har kommunen ingen skyldighet att ge information, men romer \u00e4r v\u00e4lkomna att sj\u00e4lva s\u00f6ka s\u00e5dan om s\u00e5 \u00f6nskas. Det finns ingen anledning att s\u00e4rbehandla romer i precis alla fr\u00e5gor. Ibland f\u00e5r nog romer vackert n\u00f6ja sig med att ha samma r\u00e4ttigheter som alla andra.<\/strong><\/span><\/p>\n

In the course of 2015, evictions of the two other Roma communities in Malm\u00f6, have been reported, namely ”Lucu camp”, whose residents then moved to Sorgenfril\u00e4gret, …<\/p>\n

Those Roma rendered homeless by the latter eviciton are allegedly still in Malm\u00f6, …<\/p>\n

… sleeping outside in the streets and in the parks, …<\/p>\n

… and are chased away by the police almost every night.<\/p>\n

I express grave concern at this alleged imminent eviction of Sorgenfril\u00e4gret, …<\/p>\n

… which may reinforce the exclusion and marginalized position of this Roma community…<\/p>\n

… and may have serious implications on the enjoyment of their fundamental human rights<\/strong>.<\/p>\n

I am particularly worried about the lack of reasonable alternative accomodation<\/strong> for the affected community, …<\/p>\n

Rita Izs\u00e1k m\u00e5ste l\u00e4ra sig i alla fall n\u00e5got s\u00e5 grundl\u00e4ggande som vem som har ansvar f\u00f6r vad. Det torde inte beh\u00f6va ta m\u00e5nga minuter att ta reda p\u00e5 om hon inte besitter ens denna grundl\u00e4ggande kunskap.<\/span><\/strong><\/p>\n

Furthermore, while I appreciate that substandard conditions present in the settlement may require its ultimate demolition, any such action must take place in consultation with the affected Roma community in a transparent way<\/strong>…<\/p>\n

\nI would like to refer to the International Convenant on Economic, Social to which Sweden is a party since 6 December 1971, and more specifically article 11.1 recognizing the right of everyone to an adequate standard of living for himself and his family, including housing, and to the continous improvement of living conditions.
\nThis article must be read in conjunction with article 2.2 of the Convenant which provides for the exercise of any right under the Convenant without discrimination of any kind.<\/p>\n

\nThe committee on Economic, Social and Cultural Rights in its General Comment no. 4 has stressed that the right to adequate housing includes various aspects such as legal security of tenure to protect against forced evictions and other threats; and in its General Comment no. 7 on forced evictions, paragraphs 15 and 16, states that procedural protections are essential in relation to forced evictions, including, among others, genuine consultation, adequate and reasonable notice, alternative accommodation made available in a reasonable time, and provision of legal remedies and legal aid.<\/p>\n

\nFurhermore, I would like to draw the attention of your Excellency’s Government to article 5 (e) (iii) of the International Convention on the Elimination of All Forms of Racial Discrimination, to which Sweden is a party since 6 December 1971 and which obliges States to prohibit and eliminate racial discrimination in all its forms and to guarantee the right of everyone, without distinction as to race, colour or national or ethnic origin, to equality before the law, notably in the enjoyment of the right to housing.<\/p>\n

\nI also refer to General Comment 27 on discrimination against Roma of the committee on Racial Discrimination, which notes that States must avoid any discrimination practices affecting Roma, including regarding access to housing, and in particular to act firmly against local measures denying residence to, and unlawful expulsion of Roma.<\/p>\n

\nI would like to recall the Guiding Principles on security of tenure for the urban poor (A\/HRC\/25\/54) prepared by the Special Rapporteur on adequate housing’s predecessor. I also recall the Special Rapporteur on adequate housing’s report on the obligations of subnational and local governments in the implementation of the right to adequate housing (A\/HRC\/28\/62).<\/p>\n

\nI also refer to my recent Study on the Global Situation of Roma (A\/HRC\/29\/24) which notes that that measures to confront the social-economic exclusion of Roma, including ensuring the right to adequate housing, must be part of wider approach that fosters Roma inclusion in all aspects of life, including through tackling the widespread prejudice, discrimination and racist attitudes agains Roma, including anti-Gypsism, that Roma communities regularly face.<\/p>\n

Since it is my repsonsibility under the mandate provided by the Human Rights Council to seek to clarify all cases brought to my attention, I would be grateful for your observations on the following matters:<\/p>\n

  2. Please indicate the legal basis of the planned evicition.<\/li>\n
  3. Did appropriate consultations take place with the affected persons? If yes, please give the details, date and outcome of these consultations.<\/li>\n
  4. To what extent have measures of compensation been put in place for all concerned persons, with a due assessment of the loss of their housing?

    \nSvar: Evakueringsboende 2-3 dagar. Gratis hemresa, vilket inte \u00e4r f\u00f6renligt med kommunallagen. Varf\u00f6r inte st\u00e4lla denna fr\u00e5gor (liksom andra fr\u00e5gor i detta \u00e4rende) till dem som det r\u00e4tteligen ber\u00f6r, dvs heml\u00e4nderna?<\/span><\/li>\n
  6. What has been foreseen in terms of relocation?
    \nSvar: Det \u00e4r Rum\u00e4niens ansvar.<\/span>
    \nIf sites have been designated for relocation, please provide details on the exact location, including details on the area and quality of land, access to public services and livelihood sources, and cultural appropriateness for the Roma community.<\/li>\n<\/ol>\n

Dessa trakasserier kommer att forts\u00e4tta s\u00e5 l\u00e4nge Sverige inte har en regering som s\u00e4tter ner foten.<\/span><\/p>\n

    Det finns tillr\u00e4ckligt med problem f\u00f6r svenska medborgare som skulle kunna sortera under brott mot m\u00e4nskliga r\u00e4ttigheter f\u00f6r att syssels\u00e4tta 100 personer 365 dagar om \u00e5ret, f\u00f6r m\u00e5nga, m\u00e5nga \u00e5r fram\u00f6ver, men Civil Rights Defenders vill \u00e4gna sig \u00e5t n\u00e5got som gjorts klanderfritt och som saknar alla f\u00f6ruts\u00e4ttningar att kunna leda till n\u00e5got konstruktivt. Tv\u00e4rtom kan det CRD g\u00f6r enbart skada romerna.<\/span><\/p>\n

    Med sitt agerande har Civil Rights Defenders, som sorgligt nog finansieras av SIDA, f\u00f6rlorat allt f\u00f6rtroende bland allm\u00e4nheten (exkl. v\u00e4nsterextremister) och ingen kommer h\u00e4danefter att kunna ta denna organisation p\u00e5 det minsta allvar.<\/span><\/p>\n
